Terms of Use, Shipping & Return Policies
These Terms of Use (“Terms”) govern your access to and use of the website www.silkandjade.com (“Site”), operated by SILK & JADE® (“we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms.
1. Acceptance
By using the Site, you confirm that you are at least 18 years old or accessing with permission from a legal guardian, and that you agree to abide by these Terms.
2. Use of the Site
You agree not to:
- Violate any applicable laws or regulations
- Interfere with or disrupt the Site or servers
- Upload any malicious code or harmful content
- Scrape, copy, or extract content without permission
- Use the Site for fraudulent or unlawful purposes
We reserve the right to deny access to anyone who violates these Terms.
3. Intellectual Property
All text, images, articles, product descriptions, videos, design elements, and all other content on the Site (“Content”) are owned by SILK & JADE® and protected by copyright, trademark, and other intellectual property laws.
You may not copy, reproduce, sell, distribute, or modify any Content without our express written permission.
4. Orders and Payments
Placing an order is an offer to purchase products.
We reserve the right to accept, reject, or cancel orders at our discretion.
All payments are processed through Shopify Payments, and we accept all major payment methods offered at checkout. We do not store full payment card details on our servers.
5. Reservations
Reservations for services or events are processed through a third-party application (“BookX”). Your reservation is subject to both BookX’s policies and these Terms.
6. SHIPPING POLICY
6.1 Processing Times
Orders are typically processed within 2–5 business days, excluding weekends and holidays. Processing times may vary during peak periods or while we are traveling on sourcing trips, which we post on our Instagram @silkandjadeteahouse.
6.2 Shipping Methods & Delivery
We offer shipping options displayed at checkout. Delivery estimates are provided by the carrier and are not guaranteed. Once an order has shipped, tracking information will be emailed to you.
6.3 Shipping Delays
SILK & JADE® is not responsible for delays caused by:
- Carrier issues
- Weather conditions
- Customs processing
- Incorrect or incomplete addresses
6.4 Shipping Address Accuracy
Customers are responsible for ensuring all shipping information is accurate.
We are not responsible for packages delivered to incorrectly entered addresses.
6.5 Lost or Stolen Packages
If a package is marked “delivered” by the carrier, we are not responsible for replacement, but may choose in our sole discretion to help out. We will assist in filing a claim where possible.
6.6 International Shipping
Currently, we do not ship internationally.
7. RETURN POLICY
7.1 Tea Products
- Unopened tea: Eligible for refund or exchange within 14 days of purchase.
- Opened tea: Not eligible for refund.
- If there is a product issue, we may offer an exchange at our discretion.
7.2 Glass Teaware
Teaware is eligible for refund with a $5 restocking fee. If glass teaware breaks within 30 days, we may offer a replacement at our sole discretion, generally limited to:
- Manufacturer defects
- Damage not caused by customer misuse
Proof of purchase and photos be required.
7.3 Other Products
Products (other than tea or glass teaware) may be eligible for a return or exchange within 7 days, provided they are:
- Unused
- In original packaging
- In resellable condition
7.4 Non-Returnable Items
For safety and quality reasons, the following are non-returnable:
- Opened consumable goods
- Used items
- Gift cards
- Sale or clearance items (final sale)
7.5 Return Process
To initiate a return or exchange:
- Email info@silkandjade.com with your order number and reason
- We will provide return instructions
- Customer is responsible for return shipping unless the return is due to our error
7.6 Refund Method
Approved refunds are issued to the original payment method.
Shipping charges are non-refundable.
8. User-Generated Content
If you tag @silkandjadeteahouse or submit content that features our products or brand:
- You grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, repost, modify, and distribute such content on our website, social media, advertising, emails, and marketing channels.
- You represent that you own all rights to the content or have permission to grant such rights.
We will not use private or non-public content without explicit permission.
9. Third-Party Services
We use:
- Shopify for hosting, checkout, and order processing
- Klaviyo for marketing and transactional emails
- BookX for reservations
- Instagram and other social media platforms
We are not responsible for the terms or policies of these third parties.
10. Disclaimers
The Site and its Content are provided on an “as-is” and “as-available” basis without warranties of any kind.
We do not guarantee:
- Accuracy of product descriptions
- Availability of products
- Error-free operation of the Site
11. Limitation of Liability
To the fullest extent permitted by law, SILK & JADE® is not liable for:
- Indirect, incidental, or consequential damages
- Lost profits
- Loss of data
- Business interruption
Total liability is limited to the amount you paid for the product or service giving rise to the claim.
12. Indemnification
You agree to defend and indemnify SILK & JADE® against claims resulting from:
- Your misuse of the Site
- Your violation of these Terms
- Your violation of any third-party rights or laws
13. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
14. Changes to These Terms
We may modify or update these Terms at any time. The revised version will be posted on this page.
